(en) terms of service —

This agreement is between myself, Envinae [the "Artist"], and you [the "Client"]. Failure to comply with this Terms of Service may result banned from future commissions. I, the Artist, am not responsible if the Client fails to read and confirm the Terms of Service. The Client is responsible to clarify any unsure policy with the Artist.


PAYMENT• I do not require full payment upfront, but I ask for 50% of the total cost before starting the project. The remaining 50% is due upon delivery at the latest.
Clients may also choose to pay 100% upfront if they prefer.• Payments can be made via PayPal, Ko-Fi, or bank transfer.• Each pack and individual item has a listed price. For any special requests, just contact me and I’ll provide a tailored quote.


REVISIONS• For custom orders (outside of packs), revisions are included at each stage of the process: sketch, lineart, flat colors, and final review.• For pack options, revisions are also included for each item in the pack to fine-tune details and ensure the result matches what you want. The number and type of revisions are specified in each pack’s description.• The final review is intended for minor adjustments only: small tweaks, color adjustments, or tiny details. Major changes or complete redesigns are not possible at this stage.


DELIVERY• All files are delivered digitally, with file types depending on the project: PNG, GIF, PSD, WEBM, MOV, etc.• If you need a specific file type, please let me know before the project begins.


USAGE & COPYRIGHTARTIST RIGHTS
• I retain copyright, ownership, redistribution, and intellectual property rights over all commissioned work. This includes, but is not limited to, displaying, promoting, or sharing the work-in-progress or final pieces on my website, social media, portfolio, public broadcast channels (like Twitch), and other platforms.• I reserve the right to decline any requests involving the resale of commissioned work.CLIENT RIGHTS
• You receive exclusive, non-transferable usage rights for your commissioned work for personal use.• Personal use includes: displaying the work on social media accounts for promotional purposes without direct monetization (profile pictures, banners, posts), printing and framing for personal enjoyment, and incorporating the work into designs on websites.• You CAN use the assets in Twitch or other streaming platforms, YouTube videos, TikTok, Instagram, or other content where the work contributes to revenue indirectly. Direct resale of the assets themselves (selling the files or products based on them) is not allowed.• You must not claim the work as your own and should credit me using my social tag/username/link whenever the work is displayed, or permanently on websites, social media profiles, broadcast channels, and similar platforms.• Temporary embargo / private use: if you request that your commissioned work not be shared publicly for a limited time (for example, debut streams, seasonal content like Christmas emotes, or surprise reveals), I will honor this request. After the agreed period, I retain the right to include the work in my portfolio or showcase it publicly.• You must not edit or modify the commissioned work without prior permission.• If you are a Vtuber and if you rebrand your channel or persona and wish to sell your designs alongside the work I created, you may do so, but you cannot make a profit exceeding the original price of my work. This ensures the value of the commissioned work is respected.COMMERCIAL RIGHTS
• Commercial usage rights are not included unless explicitly stated in the commission type, pack description, or agreed upon beforehand.• Commercial use covers incorporating the work into items for sale or sharing it with third parties.• For work defining your brand identity (like character designs or logos), you receive exclusive intellectual property rights for personal or commercial use, including making adaptations or derivative works, such as emotes based on your character.• Additional fees may apply for commercial use not included in the original commission, typically twice the original price.GENERAL RIGHTS
• Use of commissioned work for AI, machine learning, NFTs, blockchain projects, or other for-profit platforms is strictly prohibited.• Please credit me. For Twitch emotes, attribution should be included in panels or via Twitch’s proper attribution functionality.• You may not resell, redistribute, or claim the artwork as your own.


CANCELLATIONS• Before work begins: full refund of any payment made.• After work has started: partial refund depending on how much of the project is completed.• Custom or large projects may have specific cancellation terms, which will be discussed in advance.


COMMUNICATION• I prefer to communicate via Discord or email to ensure everything stays clear and organized.• Clear communication helps make sure your project turns out exactly how you imagined it.


A FEW THINGS TO NOTE• I reserve the right to refuse any project that goes against my ethics and values.
This includes work that is racist, harmful, or prejudicial toward any community, religion, culture, or individual.• I also reserve the right to refuse projects that make me uncomfortable or compromise my personal principles.• Prices and services may change, but I will always notify clients in advance before new projects begin.

Cet accord est conclu entre moi, Envinae [l'Artiste], et toi [le Client]. Le non-respect de ces Conditions d’utilisation peut entraîner l’interdiction de futures commandes. Moi, l'Artiste, ne suis pas responsable si le Client ne lit pas ou ne confirme pas les Conditions d'utilisation. Le Client est responsable de clarifier toute politique qui lui semble incertaine avec l'Artiste.


PAIEMENT• Je ne demande pas le paiement total à l’avance, mais je te demande 50 % du coût total avant de commencer le projet. Les 50 % restants doivent être réglés au plus tard à la livraison.
Tu peux également choisir de payer 100 % d’un coup si tu le souhaites.• Les paiements peuvent être effectués via PayPal, Ko-Fi ou virement bancaire.• Chaque pack et chaque élément individuel a un prix indiqué. Pour toute demande spéciale, il suffit de me contacter et je fournirai un devis personnalisé.


RÉVISIONS• Pour les commandes personnalisées (hors formules), des révisions sont incluses à chaque étape du processus : brouillon, lineart, couleurs, et révision finale.• Pour les formules, des révisions sont également incluses pour chaque élément du pack afin d’ajuster les détails et s’assurer que le résultat corresponde à ce que tu souhaites. Le nombre et la nature des révisions sont précisés dans le descriptif de chaque pack.• La révision finale est prévue uniquement pour des ajustements mineurs : petits détails, modifications de couleurs, ou ajustements légers. Les changements majeurs ou la refonte complète ne sont pas possibles à ce stade.


LIVRAISON• Tous les fichiers sont livrés numériquement, avec des formats adéquats selon le projet : PNG, GIF, PSD, WEBM, MOV, etc.• Si tu souhaites un format particulier, merci de me le signaler avant le début du projet.


UTILISATION & DROITS D’AUTEURDROITS DE L’ARTISTE
• Je conserve les droits d’auteur, de propriété, de redistribution et de propriété intellectuelle sur toutes les œuvres que je crée. Cela inclut, sans s’y limiter, l’affichage, la promotion ou le partage des travaux en cours ou des œuvres finales sur mon site web, les réseaux sociaux, mon portfolio, les plateformes de streaming (comme Twitch).• Je me réserve le droit de refuser toute demande impliquant la revente de l'élément commandé, afin de protéger l’intégrité de mon travail.DROITS DU CLIENT
• Tu reçois des droits d’utilisation exclusifs et non transférables pour ton œuvre commandée à des fins d'usage personnel.• L’usage personnel comprend : l’affichage sur tes réseaux sociaux à des fins promotionnelles sans monétisation directe (profil, bannières, publications), l’impression et l’encadrement pour ton usage privé, et l’intégration dans des designs sur ton site web ou tes chaînes, toujours sans vente directe de l’œuvre.• Tu PEUX utiliser les éléments graphiques sur Twitch, ou sur YouTube, TikTok, Instagram, et tout autre contenu où l’œuvre contribue indirectement à des revenus. La revente directe des fichiers ou produits basés sur les éléments n’est pas autorisée.• Tu ne dois pas revendiquer l’œuvre comme tienne et tu dois me créditer via mon pseudo/tag/lien à chaque affichage, ou de façon permanente sur tes sites web, profils réseaux sociaux ou chaînes.• Embargo temporaire / usage privé : si tu souhaites que ce que tu as commandé ne soit pas partagé publiquement pendant un temps limité (par exemple pour un premier stream, des emotes saisonnières comme à Noël, ou des surprises pour ton audience), je respecterai cette demande. Après la période convenue, je me réserve le droit de présenter l’œuvre dans mon portfolio ou sur mes réseaux.• Tu ne dois pas modifier l’œuvre commandée sans mon accord préalable.• Si tu es un Vtuber et que tu passes par un rebanding de ta chaîne ou ton personnage et souhaites vendre tes designs avec les éléments que j’ai réalisé, tu peux le faire, mais tu ne peux pas tirer un profit supérieur au prix original de mon travail. Cela permet de respecter la valeur des éléments commandés.DROITS COMMERCIAUX
• Les droits commerciaux ne sont pas inclus sauf mention explicite lors de la commande, le descriptif de la formule, ou un accord préalable.• L’usage commercial inclut l’intégration de l’œuvre dans des produits destinés à la vente ou le partage avec des tiers.• Pour les créations définissant ton identité de marque (comme des personnages ou logos), tu reçois les droits de propriété intellectuelle exclusifs pour un usage personnel ou commercial, incluant la création d’adaptations ou d’œuvres dérivées, comme des emotes basées sur ton personnage.• Des frais supplémentaires peuvent s’appliquer pour un usage commercial non inclus dans la commande initiale, généralement 2x le prix original.DROITS GÉNÉRAUX
• L’utilisation des éléments commandées pour l’IA, l’apprentissage automatique, les NFT, les projets blockchain, ou toute autre plateforme à but lucratif est strictement interdite.• Merci de me créditer. Pour les emotes Twitch, l’attribution peut être incluse dans les panels ou via la fonctionnalité d’attribution Twitch.• Tu ne peux pas revendre, redistribuer, ou revendiquer l’œuvre comme tienne.


ANNULATIONS• Avant le début du projet : remboursement complet de tout paiement effectué.• Après le début du projet : remboursement partiel selon l’avancement du travail.• Les projets personnalisés ou de grande envergure peuvent avoir des conditions d’annulation spécifiques, qui seront discutées en avance.


COMMUNICATION• Je préfère communiquer via Discord ou email pour que tout reste clair et organisé.• Une communication efficace permet de s’assurer que le projet corresponde exactement à ce que tu imagines.


QUELQUES POINTS À NOTER• Je me réserve le droit de refuser tout projet qui va à l’encontre de mes valeurs et de mon éthique. Cela inclut tout travail raciste, nuisible ou préjudiciable envers une communauté, religion, culture ou individu.• Je me réserve également le droit de refuser des projets qui me mettent mal à l’aise ou compromettent mes principes personnels.• Les prix et services peuvent évoluer, mais je veillerai toujours à t’informer à l’avance avant le lancement de nouveaux projets.
